Terms of service

These terms are a plain-English summary written for a small business audience. They are not a substitute for a solicitor reviewing them before you rely on them commercially.

1. Who we are

PlantHire OS is operated by TGF Digital. "We" and "us" mean TGF Digital. "You" means the business that has subscribed, and the people it authorises to use the service.

2. What you get

Access to the PlantHire OS dashboard, API and apps for the plan you have subscribed to, for as long as you pay for it. Plan limits are published on the pricing page and enforced in the product.

3. Payment

Subscriptions are billed monthly in advance through Stripe. The first fourteen days are free and nothing is charged until they end. Cancel at any time from your dashboard; you keep access to the end of the period you have paid for, and we do not refund part-months.

4. Your money and your customers

Deposits and hire charges you take from your own customers go through your own Stripe account, directly to you. We are not a party to those transactions, we do not hold that money, and we take no percentage of it. Your contract with your customer is yours.

5. Your data

Your data is yours. We store it to provide the service and for no other purpose. We do not sell it, and we do not use one yard's data to serve another. Ask and we will export it to you. If you cancel, we keep it for thirty days in case you come back, then delete it.

6. What the identity checks are and are not

The document checks are an automated triage tool. They read file metadata and document text and give you an indication. They are not a licensed identity verification service, they do not check documents against any issuing authority, and they do not perform credit or biometric checks. The decision to hire remains yours, and so does the risk in it.

7. Compliance reminders

LOLER and PUWER reminders are a convenience based on the dates you enter. Keeping your equipment examined and safe is your legal duty, not ours, and a missed reminder does not transfer that duty to us.

8. Acceptable use

Do not use the service to break the law, to store other people's data without a lawful basis, or to attack the service or anyone else through it. We may suspend an account that does, and we will tell you why.

9. Availability

We aim to keep the service up and we will tell you about planned maintenance, but we do not offer a contractual uptime guarantee at these prices. If we ever do, it will be written here.

10. Liability

Our liability to you in any twelve-month period is limited to what you paid us in that period. We are not liable for lost profit, lost hires, or damage to equipment. Nothing here limits liability that cannot lawfully be limited.

11. Changes

If we change these terms materially we will email you at least thirty days beforehand. If you do not like the change, cancel before it takes effect.

12. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
